厂房火灾房东有责任吗

租赁合同有约定的从约定,没有约定修缮义务归属的,原则上由出租方负责修缮,但是由于承租方的过错造成损坏的由承租方负责。

出租厂房因承租方原因发生火灾房东要承担责任吗

要看什么原因的，如火灾是由于建筑本身（如非法改造）原因或者管理不善（消防安全隐患不解决）原因而导致的火灾，房东是需要承担责任的。

2017年的11月20号，湖州市吴兴区大港村一民房，突然着火，导致另外两名租客死亡。

火灾发生后，经吴兴区消防大队调查，起火原因为停在楼梯间内的电动自行车违规充电引发火灾。经法院审查查明，该电动自行车所有人为被告人胡某，当晚其由自己房间内临时拉出电线给电动车充电，且将电动车停放在楼梯间内。起火后烟气沿楼梯向上蔓延，导致楼上租住人员无法逃生，从而造成租住在此的李某父子吸入炭尘、一氧化碳后双双殒命，其行为构成失火罪，于2017年11月20日被吴兴区公安分局刑事拘留。

与此同时，经法院审理查明，2004年以来，被告人强某将位于吴兴区大港村强家兜9号的自建房出租给被告人胡某等人使用。在此期间，公安、消防和当地政府多次对强某的出租房进行消防检查，发现存在较多消防安全问题，特别是在2017年11月15日向其发放责令整改通知书，要求拆除私接电线，租房内充电的电动自行车一律停到租房外面。强某签收通知书后依旧我行我素，对存在的隐患视而不见，不配合整改，终于在事隔5天后酿成大祸。

法院认为，被告人胡某因过失引发火灾，情节较轻，其行为已构成失火罪；被告人强某作为直接责任人员，违反消防管理法规，经消防监督机构通知采取改正措施而拒绝执行，造成2人死亡的严重后果，其行为已构成消防责任事故罪。

火灾发生后，经调解，胡某、强某赔偿遇难人员家属116.2万元。但再多的钱，也无法挽回逝者的生命。

什么是失火罪：

是指由于行为人的过失引起火灾，造成严重后果，危害公共安全的行为。这是一种过失危害公共安全的犯罪。

什么是消防责任事故罪：

消防责任事故罪，是指违反消防管理法规，经消防监督机构通知采取改正措施而拒绝执行，造成严重后果的行为。犯本罪的，处三年以下有期徒刑或拘役；后果特别严重的，处三年以上七年以下有期徒刑。

作为房东和租户，

对于消防安全都不能疏忽。

出租房消防安全，人人有责！

特别是那些“甩手”房东，

对出租屋要进行有效管理和维护，

否则租客失火，

自己也要承担连带法律责任！
